Pet Portrait Photography Contract - Mont Blanc Photography

 

This contract is between the CLIENT listed below (referred to as "CLIENT") and the  PHOTOGRAPHER (referred to as " PHOTOGRAPHER"). By digitally signing, the CLIENT agrees to the terms and conditions outlined herein.

 

1.    Services Provided. The  PHOTOGRAPHER will capture images of the CLIENT and their animal during a scheduled photo session. The CLIENT will receive a curated selection of edited images, chosen at the  PHOTOGRAPHER's sole artistic discretion. These images will be available for viewing exclusively during the photo viewing and purchasing session.

 

The PHOTOGRAPHER does not provide the option for photos or galleries to be viewed or selected at home outwith the photo viewing session attended by both parties. Each image chosen for purchase will include a web-resolution file (1800px on the long side, 72dpi). Full-resolution digital files are available for purchase at an additional cost. These images will be color-corrected and lightly retouched. The  PHOTOGRAPHER will undertake one further round of editing within the limits of this contract following a CLIENT’s request. Additional retouching will incur extra fees.

 

2.    Payment. The session fee must be paid in full at the time of booking to reserve the session date. No products, including digital files or prints, are included in the session fee. The CLIENT acknowledges that they have downloaded and reviewed the  PHOTOGRAPHER’s Art Brochure and understand the pricing for digital and print products.

 

3.    Cancellation and Rescheduling Rescheduling.

 

a.    Cancellation: The CLIENT may cancel the session without penalty up to 14 days before the session. If canceled within 14 days or if the CLIENT fails to attend, the session fee is forfeited.

b.    Late Arrivals: Any late arrival by the CLIENT will reduce the session time accordingly without a refund.

c.     Sickness: Rescheduling due to sickness is permitted with written notice from either party. The session must be rescheduled within the same calendar year, and a new date will be mutually agreed upon.

 

4.    Failure to Perform. The  PHOTOGRAPHER agrees to cooperate and communicate cheerfully during the session. However, the  PHOTOGRAPHER cannot be held responsible for missed photographs due to weather conditions, non-cooperative animals, or any other factors beyond their control. The  PHOTOGRAPHER is not liable for images not captured due to the CLIENT's or their animals' behavior.

 

5.    Animal Handling and Responsibility. The CLIENT is fully responsible for the handling, behavior, and safety of their animal(s) during the session. The  PHOTOGRAPHER assumes no liability for any incidents, injuries, or damages caused by the animal(s).

 

6.    Creative License. The images are created and edited solely at the  PHOTOGRAPHER’s discretion. Delivered images will not include all images shot. The  PHOTOGRAPHER will edit and release only those images that meet the  PHOTOGRAPHER’s professional quality standards and artistic vision. The  PHOTOGRAPHER will not release RAW or unedited files.

 

7.    Use of Images and Copyright. The  PHOTOGRAPHER retains exclusive worldwide copyright to all images. The CLIENT is granted a non-exclusive, non-transferable, and revocable license to use the images they have purchased for personal, non-commercial purposes only. The CLIENT agrees not to alter, crop, or apply filters to the images. The images may not be submitted to contests or used for commercial purposes without the  PHOTOGRAPHER’s written consent.

 

8.    Delivery Schedule Prints.

 

a.    Delivery of prints will take up to 3 weeks from the order date.

b.    Albums and Wall Art: Delivery can take up to 4 weeks.

 

9.    Fair Usage of Photos. The CLIENT is permitted to print, display, and use the images they have purchased for personal use only. The web-resolution digitals provided with their purchased prints are not designed to be printed but are intended for social sharing and screen use only. With the  PHOTOGRAPHER’s written consent, the CLIENT may use the web-resolution images for small prints, such as mugs and mouse mats, for personal use only. This consent must be obtained before any such use. The CLIENT shall not reproduce, submit to contests, or authorize third parties to reproduce the images without the  PHOTOGRAPHER's express permission. Additional prints and/or digital files may be purchased with the  PHOTOGRAPHER’s permission.

 

10. Editing and Final Images. The  PHOTOGRAPHER will edit photos at their sole artistic discretion, removing minor blemishes or temporary imperfections while maintaining the integrity of the subject’s natural appearance. However, the  PHOTOGRAPHER will not alter the images in a way that changes the recognizable appearance of the subject (human or animal), such as altering eye color, hair/fur color, or the original subject’s size. The CLIENT agrees never to edit or apply filters to the  PHOTOGRAPHER's images.

 

11. Model Release and Compensation. Within the terms of this model release contract, the CLIENT acknowledges that the session fee has been waived (250 CHF for weekend sessions and 150 CHF for weekday sessions). Additionally, the CLIENT has been gifted a non-transferable, non-redeemable money-off voucher of 150 CHF. This voucher may only be applied towards the purchase of photos and products from their photography session and can only be used during the photo viewing and purchasing appointment immediately following their session.

If the CLIENT later rescinds this agreement and requests that their photos no longer be used by the  PHOTOGRAPHER, the CLIENT agrees to reimburse the  PHOTOGRAPHER as follows: The full session fee (250 CHF for weekend sessions or 150 CHF for weekday sessions) that was initially waived. The value of the money-off voucher (150 CHF) if it has been applied. An additional fee of 80 CHF for the gift print provided under this agreement. These fees are payable within 14 days of the CLIENT’s notification to rescind the agreement.

 

12. Liability and Force Majeure. The  PHOTOGRAPHER is not responsible for any circumstances beyond their control, such as natural disasters, technical failures, or other unforeseen events. In such cases, any fees paid will be refunded, and the  PHOTOGRAPHER shall have no further liability or obligation to the CLIENT.

 

13. Final Agreement. This contract constitutes the entire agreement between the  PHOTOGRAPHER and the CLIENT. Any modifications must be in writing and agreed upon by both parties.
